SFHA submits response to Co-op and Community Benefits Societies consultation

SFHA has submitted its response to the Law Commission's consultation looking at the Co-operative and Community Benefits Societies Act.   The response was developed with input from TC Young and was discussed at both our Governance and Governing Body Members' Forums.

Whilst much of the consultation paper is not relevant to our sector, many proposals could have an impact, particularly in respect of necessary revisions to the SFHA Model Rules.  These include proposals to amend the definitions of both Co-operatives and Community Benefits Societies and making all governing body members subject to the director’s duties in the Companies Act 2006. 

SFHA has asked the Law Commission to amend its proposals where they do not accurately reflect the activities of housing associations and co-operatives.  SFHA attended a roundtable event with the Law Commission and other housing organisations from England and Wales in November, at which it seemed receptive to making some of the changes outlined in the SFHA response. 

Any recommendations that the Law Commission ultimately makes following the consultation period are not likely to come into effect until 2026/27 at the earliest, following a further period of consultation by the UK Government.
