GDPR Model Documentation, Guidance Notes and FAQs - August 2021 update

This update reflects legislative changes since 2018 to the requirements of the General Data Protection Regulations (GDPR), with particular focus within the FAQ document on Brexit.

In 2018, SFHA and GWSF commissioned TC Young to produce guidance and model documentation to assist members in meeting the requirements of the General Data Protection Regulations (GDPR). This 2021 update reflects legislative changes since then, with particular focus within the FAQ document on Brexit.

Brexit is not expected to have a great impact in respect of GDPR, particularly following the adequacy decision that has now been reached with the EU.  The adequacy decision in respect of the UK means that UK legislation sufficiently meets the EU data protection standard without the need to implement additional safeguards. 

In recognition that many members will have based their documentation on a previous version of this guidance, tracked changes versions are included within the guidance (reflecting both the October 2019 and June 2021 minor updates).

The documentation and guidance provided is designed to assist members in ensuring that your data protection documentation is in line with the requirements imposed on you by the GDPR. Please note, members are encouraged to take their own independent legal advice in relation to the finalisation of their updated data protection documentation.
