Correction notice: eviction orders ban

SFHA issued information on Friday which stated the Scottish Government had announced it intends to extend its temporary ban on eviction orders until September. This is incorrect.

We stated that the extended ban will apply to all evictions in areas subject to level 3 or 4 restrictions with exemptions remaining in place for criminal or serious anti-social behaviour. However, this is entirely separate legislation and has no bearing on the local levels regulations that brought in the temporary ban on eviction orders.

The Scottish Government did announce last week its reasons for extending certain provisions within the Coronavirus Scotland Act 2020 to September 2021, this includes the extended notice periods for evictions. We understand the Scottish Government is also considering whether to extend the local level regulations which include the temporary enforcement action ban on eviction orders currently in place, but no decision on this has been taken yet.

A Statement of Reasons setting out why the elements proposed by the Scottish Government of the Scottish Coronavirus Acts should be extended was laid in Parliament last Wednesday 24 February and can be found here.
